My nephew is being charged with first degree murder on someone who he knew, but they broke in his home and attacked him. So he defended himself the best he could, until the man started choking him and he reached for his gun and shot the guy. They are saying it was pre-meditated. A lady was there and she got into some serious trouble and now her charges were dropped and she is testifyingforr the state.

  1. What you are talking about is not an "expungement" but plea bargaining.  The State has made a deal with a witness to dismiss or not file charges against him/her in exchange for his/her testimony.  This is a common tactic that district attorneys use in order to make their case better.  Fortunately any deal made has to be disclosed to the defense attorney and can be used against the witness in the trial.  For whatever reason in your nephew's case, the state has decided to use all means necessary to convict.  I hope he has a good lawyer and I wish all of you the best of luck.
