Can the Developer claim ownership on teh terrece of teh apartmnet?

I have purchased an apartmnet 7 months back and currently staying their. All the houses are occupied. Now developer is saying, he has right on terrece where he can construct if corportaion gives him permission. But my understanding is terrece is a common area and same is mentioned in the sale deed also. So does his claim valid.
