Can the State of TN take my license away for having an accident will not being insured?

I was in an accident June 12 2007! i rear ended a car. not much damage at all i think i hit her car doing like 10mph and scratched the paint off. The reason i hit her was because she slammed on her brakes to make a turn onto a road she about missed. Well the question is can they take my license? about 8 months ago i recieved a packet of stuff from her insurance company saying they are suing me for 5,000.00. that is the total cost of damage, rental car, medical bills and what nots. Well first off i was billed 406.00 for a rental car for 12 days when it only took 3 days to repair her car! then i was billed for doctors visits and it clearly states on the form that i recieved was this visit to the doc caused by auto accident she checked NO! why am i being billed for doctors visits when she clearly checked no on the forms!!!!! and why was it 3000.00 to repair her car! her car was not even worth 3000.00! it was a 98 nissan sentra! KBB says 4200.00! I am going to court soon. please help!!

Driving without insurance (and subsequently being at fault for an accident...which makes it worse) is grounds for the state to take your driver's license away.  Even if you just would have been pulled over in a routine traffic stop, with no accident, the state can revoke or suspend your license for driving without insurance.

    Edit - never mind, I read your question wrong - You're going to have to pay for the repairs to her car (since you caused the damage and don't have insurance to cover the costs).  As far as the other facts you're disputing (like the extra 9 days of rental car costs or the medical bills that she may have waived her right to by signing something), go buy an hour of time with a traffic law or defense attorney and get legal advice from them, not someone on Yahoo answers.  The hour of time spent with the lawyer will probably save you hundreds of dollars in the long-run in the lawsuit.  

    Good luck with the lawsuit and for your sake and the sake of everyone else on the road, go out and get some car insurance whenever you get your license back!

    The law requires insurance.

    You have broken the law and probably will have license suspended.

    Additonally, without insurance you are responsible for all damages to both vehicles

    should read "while not being insured" ?

    I can only give information as it applies in the UK. If you have no insurance and are caught driving, it is usually  an automatic disqualification, unless you are able to show extenuating circumstances and from your post you do not seem able to provide any. Sorry flower!! On the other hand if you are going to Court, explain that there are extenuating  circumstances  to the official, whoever it is and they may be lenient, but don't bank on it. You should not be driving without Insurance which I am sure you know already? What if you had knocked over a child? Best of luck

  4. Well, TN doesn't require liability insurance, as long as you've posted that bond.  But if you didn't post that bond, and you didn't get liability insurance, then yes, they can suspend your license and require you to get insurance with an SR 22 filing.

    You're being billed for rental and doctor visits because, regardless of why she checked which box, she's claiming you caused her injuries.

    You're going to lose in court.  You rear-ended her.  She's asking for the LESSER of cost of repair, or ACV.   12 days rental is NOT unreasonable.  And you owe her medical payments.  She can ALSO sue for pain and suffering.

  6. Forget about all you have paid out. It won't matter in court since they are only interested in you not having insurance when the accident happened. Hopefully, you will have coverage when you appear in court, or I can almost guarantee loss of your license. Argue the other bills you have paid in a seperate court case.

  7. Yes, the state can and probably will suspend your license (I am surprised they have not done so already-in fact, you should check on your status) for driving while uninsured.  You will also face fines.

    If I were you, I would take the information you have to a lawyer.  Perhaps they can help you.

    If KBB says 4200, then yes, her car was worth 3000-in fact, it was worth more.  You can try to dispute some of this in court, but the fact that you were driving uninsured is not going to have anyone on your side.

    What does the initial accident report state?  Do you have witnesses that can atest to the amount of damage that occured?  The policeman should have documented it.
