Can the Supreme Court Justices be tested on their overall comprehension of the US Constitution?

  1. That's what the Senate/House of Reps. is supposed to do prior to confirmation of each nominated Judge.


  2. They just were.  5 understand the Constitution and the 2nd Amendment, 4 do not.

  3. well i think that they are constantly being tested. and if they didnt understand it, then why are they justices, it all goes hand in hand. the president specifically chose them for their ability.

  4. No---but the Congress has power to revise the Judiciary---also the SCOTUS has no authority to intrepret the Constitution but can decide cases they choose to hear---therein lies the failings of the SCOTUS---if they do not want to rule they simply refuse to hear a case.

  5. The all WERE... it was during their Senate Confirmation Hearings.  

    Interestingly, the Constitution does not set forth any qualifications for service as a Justice, the President may nominate anyone to serve.

    However, that person must receive the confirmation of the Senate, meaning that a majority of that body must find that person to be a suitable candidate for a lifetime appointment on the nation's highest court
