I have a two month old baby, the father wasn't there for the pregnancy, or the birth. He isn't on the birth certificate either. He wanted to see the baby, so I let him, and now he wants to file for custody. My son already has a father. Although not biological, but still a great dad. i just want to start my life new. and this guy is messing that up.

  2. Yes, he could get a court ordered DNA test (which he would have to pay for) and if he is the father, he&#039;s entitiled to the same things all other parents are entitled to.

  3. yup the court can order a dna test, and if that goes through he can file for custody as he will be entered at the birth certificate

    and there is no reason the child cant have 2 fathers, its perfectly normal these days

    i myself have 3 parents, both my BFs B.parents have remarried as well, so as it all stand today when i have kids they will have 7 grandparents (8 if my dad find a new woman)

    more people to love the kid and be there for it, nothing wrong in that, its a resource not a backside

    as long as he is a descent person, then why waste both your time energy and money on this, acknowledge him as a father and work out visitation rights for him out of court, much easier on all of you and the money can be set into a bank acount instead towards the kids education instead of wasted on lawyers

  4. Yes, he can ask for visitation and eventual custody.  You&#039;d need to check the specifics for wherever you live, however.

  5. why can&#039;t you work something out so you both get to see him and be in his life just because things did not work out between you 2 does not mean he is not the dad you need to work something out between you both to have a decent relationship and be able to get along for your son..besides as long as he is seen as fit he will get at least partial custody you might as well try and do it the right way

  6. of course he can. You have a good chance of winning though because he wasn&#039;t involved. . .unless you didnt tell him he could be the father. . . then he has a good chance. There is no such thing as starting life new. Growing up and being mature enough to be a parent means learning to live with your mistakes and doing what is best for your children.

Yes, he can.  He would have to go to court and request a paternity test to prove he is the father.  If he is, then yes, he can petition the court for visitation or for custody.  It would be unusual for a judge to grant sole custody to the father if you are found to be a fit mother.  But a judge could grant joint custody and/or liberal visitation rights.  If he pursues this, you&#039;ll want to find a decent lawyer who specializes in family law.
