Question:

Can the company I work for withold holidays I'v accrued untill I'v completed my 3 months probationary period?

I have been working at this company for 2 months now and am on a three month probationary period like every job. I have just found out that I can not take any holidays untill i have been there for three months. Even the ones I have accrued. This can't be right surely as they are bound by law but the probationary period depends on the company policy (some companies have one month, some have three). Does anyone know weather what they told me is right?

PLEASE DO NOT ANSWER UNLESS U KNOW. DO NOT JUST SPECULATE.

  1. The amswer is, you were told you are on trial, 2, after 3 months, you will start accuring holiday time, but don't be thinking halfway thru month 4 you wanna take 2 weeks off because the answer will be a firm No. I would say when you have been there 6 months you could take 1 week off .

    Your employer should of told you about holidays and hours when you were taken on , or did they forget .

    You accrue holiday pay as you go along. The company can, if they wish, allow you take unaccrued or even unpaid leave but it is up to them. It is not a legal stipulation that you cannot take holidays before you accrue a full weeks worth (usually 3 months work = 1 working weeks holiday appx.). The legal bit that Bud is talking about is the onus on the employer to allow you to take holidays after an initial period.

    Check your contract - i have worked in recruitment for many years and find that very few people check the terms of engagement - which causes no end of grief!

    Straight forward answer to your question is  - Yes!

  3. in the US, yes they can. my probationary period was 6 months and although i accrued vacation days, i was unable to take them until i completed those 6 months. it is to ensure that you don't take all this time off, get paid for it, and then quit after you use all those days. it sucks for us but it makes sense, they are just trying to protect themselves.

  5. by law you have to work 3 months before you get 1 week 1 day holiday pay, if you want 2 weeks holiday at the same time you will have to work 6 months, I am an employer and know this is right
