Can the magic jack be tapped?

Can the magic jack be tapped?

Tryed to call when the commercial was on and ask but it's all done threw machines and there is no human to talk to.

Anyone know if it would be possible for the police to tap it?

Since it does not work like a normal telephone, the police could not "tap" it like a land line.  The Feds might be able to do some packet sniffing on the VoIP data but there would have to be a reason to do so.
