Question:

Can the manager of my building tell me how many visitors i can have at my loft?

I have been leasing for almost a year, never once late. Occasionally i will have a party, however i invite all of my neighbors, they all come and have even vouched what a nice person i am.

The partys are not loud or out of control. However one time the owner and his friend came to a party, the friend of the owner of the building tried to hook up with my friend and she declined. Now they are harrasing me, everytime I have guest over.

once they even said, i didnt pay a months rent, but when i provided a copy of the cashiers check, they said nothing, not even a im sorry for the mistake. they also have the security in the building harass anyone who comes and visits me, but never do this to any of the other tenants.

then they said i owed 45.00 (for what i don't know) so i paid it, meanwhile someone in the managers office said that there are people who owe thousands of dollars and they don't say anything, because they are friends of the owner.

when i have a party by the pool, they call the police and say i can only have 2 people in my loft. but just last weekend, someone had a party at the pool with over 25 people, when i questioned them, they said, it was a group of people in the building who got together to do it. now they served me with notice that they will not be renewing my lease. is this legal?

oh, i forgot to mention, they fired one of the leasing agents in the building, because they wanted him to evict me, and he said, i can't just evict her, we have to have a reason, ( i guess they thought we were friends, which we weren't although, he was the one telling me how they have targeted me and that the owner doesn't like me) I met the man one time at my party.

right after that, is when they started having the guards in the building call the police if i have more than 2 people over and harrasing my friends.

my loft is 1500 sq ft. and i pay 2500.0 a month to live there.

  1. No - they cannot do that!

    The only thing a landlord can regulate regarding guests is with staying over.  Most leases state that a guest can't stay more than x # of night ina one month period and that is just because they start looking like another tenant.

    Like others said they can refuse to renew your lease for no reason. but they cannot flat out kick you out.  Pursue it in court if you have the funds to do so, because this harassment is definitely illegal.

If your visitors weren't being a nuisance, it might not matter.  It seems they are, though.  There are other residents paying as much as you do who don't find your parties all that enjoyable.  If the police are being called, you need to calm things down.  What the heck has discrimination got to do with anything?  You just need to be more considerate.

  3. No, it is illegal to dictate what is referred to as "lifestyle" in a rental property unless the owner is occupying within the same walls as in a boarder situation.

    Some people will post that if it's in the lease, and you signed it, you are SOL...that isn't true.

    Just b/c you sign a contract, doesn't equal legally binding...if it violates the laws, then it was void before you signed it.

    I have never seen a landlord successfully evict a tenant in court due to a tenant's "lifestyle".

    Start documenting and have the police file a report EACH time they come over...they'll do that even if it's nonsense.  After you have about 3 of those, you'll be able to have a case for harrassment...b/c that proves it.


  4. They can opt to not renew the lease for any reason, even no reason.

It sucks that they have harrassed you so much and they have no right to tell you how many friends you can have in your home at once as long as it does not cause any danger to other tenants or the property. However, if they decided not to renew your lease there is nothing you can do except start looking for a new place that will  hopefully be a more enjoyable place to live.

  6. Do you really want to stay there with that attitude?  I'd start looking for another location.

    While you are still there, read the copy of rules they should have given you when you moved in.  If you don't have a copy, request one.  They can't have special rules just for you.
