  2. If it is for a civil matter or civilian criminal court you have to get your own attorney.  If it is for a military court then they have to provide you a JAG attorney.

Depend what issue is, if is something off duty and personal, is up to your own expense and hired out side attorney, but if something to do with on your duty, then you had to go over with military lawyer, regardless you wanna or not, since you are part of government property when you in contract.
