  3. if he is not on the birth certificate then yes but if he is then he would have to give up parental rights to the child first.  and if there was a paternity test done the he would have to sign over his rights that way too.

If the father of the child has made no contact within a year in the form of mail child support or in person, than yes you can file abandonment on the father, you will have to proceed placing an add in the news paper for no less than 90 days to notify the natural father of th intent of adoption by the new father. I highly recommend you get an attorney this is a long process, Ive been part of 2 such cases 1 a friend where all partys are american.. 2 my uncle and the natural father was still in philliphines. both adoptions went through fine and all parties are still very happy with the out come.   7. Why would you want to do that? No and if you go around him you could get in trouble. I understand their are alot of men that doesn't want anything to do with their children but then their are men like my son that does(he has been fighting in court for 2 years to get his son back after he was put up for adoption) and then their are mothers like you that want to go around them. Answer this how would you feel if the father was doing the same thing to you? If you have the father's consent it's cool but if he doesn't want to then he wants to be there for the child.

No, by law a man can not adopt another mans biological child  without his consent but, if the bio father doesn't have any communication with the father or pay child support the child's mother can try to have the biological fathers parental rights terminated for abandonment and therefore the new man could adopt.

My husband and I are going through this process as I type.  It is possible but only if you meet the criteria that has already been mentioned in several of your answers.  We are proving abandonment in order to proceed.  For all of you that think this is not ethical, do you think that it is ethical for these fathers to leave their children and only look back when it is convenient for them.
