Can the police search a person house without a warrant, without the peson present and there was no indication.

Man either people lie or this really occured. As my friend missed our party that we have been planing for a long time now. but was a no show and there excuse was there house was searched and there was no one there and they never left a copy of a warrant on the door to indicate there were there. But there is apparently people that saw this took place. But is another made up story by our imaginative friend or could this have really happened.

I feel bad as what if it did and here I am in doubt....

  1. In order for the police to enter your residence they must have a warrent or your permission.  By opening the door to the residence you have given permission for them to come into the residence.


  2. Google "Sneak 'n Peek" and you will find out. It is a provision of the PATRIOT Act that allows the police or any other law enforcement agency to do just that.

    Be sure to thank your senators and congressman for making sure our country is safe and secure because that pesky 4th Amendment to the Constitution is no longer in the way.

  3. How do you know who has or hasn't been 'subject to the Patriot Act'? That is the most ridiculous things I've read on here [and I frequent the MMA portion of the site where all the TUF gnubs spout nonsense about Roger Huerta being great]. If they weren't going to utilize the expanded authorities why would they have passed the goddamn Act? Just bored. "Oh, we're so bored today. Let's pass this thing called the Patriot Act that puts us this much closer to officially being a police state. Moreover, let's suspend Habeas Corpus. Hitler did it afterall. That's all the precendence we need."

    The bottom line I think you're asking is whether or not your friend is telling the truth.  Nobody here knows.

    Is it possible a residence (in the US?) can be legally searched without a warrant or consent?  Yes, it's possible.  There are a few other legal theories that might allow for a residential search but again, there's no way to know because there's just not enough information in your question.

    And I guess I have to ask - if the house was searched, and nobody was there, that means your friend was not home, right?  If they weren't home, why weren't they at the party?

  5. Mikeysco makes a great point, if your friend's house was searched when no one was there.  Then where was your friend?  Not at home, and not at the party.

    Can police search your house if no one is home?  Yes.  If there is a warrant, or if there are extenuating circumstances.  Otherwise, no.  They would need permission.  Either way, they would not search and leave without leaving a receipt or acknowledgment that they had been there.

    Sounds like a made up story.

I see the verbal UNINFORMED ILLITERATE are out in droves here....The Patriot act deals with INTERNATIONAL MATTERS ONLY...the "sneak and Peek" refers to little snippets of sound they pop in on ....on INTERNATIONAL CALLS TO KNOWN TERRORIST AFFILIATES.....It has not been used in ANY domestic eavesdropping and NEVER for a search...try READING the Act and not listening to the liberal wackos.....

Ross is being an ***.  I don't think you would even be able to find someone online that even knows someone that has been subject of the patriot act.  It's almost never used, and certainly not in your circles.  If the place was searched, they should have left a copy of the front page of the search warrant.  Otherwise, they would have needed permisson from ANYONE that was allowed in the house.  That means even a friend with a key that had permission to the spaces in the house the cops searched.  Think of it like this.  If you have permission from a person to be somewhere, you have legal permission to allow the police to search it.

    Umm.  Ok Delta, next time you file a court order under the patriot act, you let me know, because I've only done it twice in the past 5 years and it had nothing to do with anything remotely related to domestic affairs.
