Can they charge him both offenses?

my husband got caught driving (which is his fault for driving) but they are trying to charge him with driving while suspended and driving without ever having received a license. if he has never had a license how can they be suspended? can they charge him with both charges or will they have to drop a charge? please help i am scared i already know that when he goes to court tomorrow they are going to put him back in jail because we don't have his bond money

  1. On the face of it, they should only be pursuing one charge. They certainly can charge for both, but any defense can use the evidence the prosecution would use for one charge against the other, and end up getting off on both. One would probably be dropped before reaching the court.

    However, I am a little confused. Driving without a license is a crime, and that should be enough. I've never heard of any law that specifies driving without ever having had a license in the first place. Could you double check exactly what that second charge is, you might be able to get a better answer.
