Question:

Can they deny my entry even though i have a visa?

I currently have a valid USA turist visa.

However, 3 years ago i had overstayed for 4 months, while i could only stay for 6 months. I want to go back on my honeymoon this summer. Are there great chances for entry denial? I have a signed paper from my job, bank statement, the honeymoon cruise tickets etc etc. which are a proof tht i do not intent to stay there.

Any advice?

  1. if you overstayed, the likelihood of the immigration noticing it is great,

    you overstayed 4 months? well? do not wait for the welcome committee,i mean, yes do expect it, it will show up, you may just be send back to where you came from....after landing in the US.

    all the papers that you are willing to show? will mean nothing, you have broken the law, sorry............this is what immigration calls it;


  2. Chances are very strong that you'll be denied entry, have your visa revoked and be sent back to your country. When you overstay your visa, you have basically violated the terms of your visa when you entered. It's unlikely that they be willing to overlook the fact that you overstayed by four months, although it is at least possible.  Had you overstayed by 2 more months, you would have been ineligible for 3 years, and there would be no doubt at all about cancelling your visa. In reality, there's no way to know absolutely what will happen if you come in on your current visa until you are here at the immigration window, but at that point, the price of guessing wrong will be very high.

  3. Even with a valid visa, the Immigration Officer at the point of entry has the last say whether you may enter or not or how long you can stay. No bank statement or employment certification will make them change their decision. Just have a good reason  why you overstayed the last time IF asked. If not , do not bring it up. Good luck.

I don't know who gave Spotter thumbs down he was correct. - Yes the last say has the immigration officer but to be honest this is a very unlikely event since it is already in the computers of the embassies that you overstayed and the visa is granted. You are comin to spent money in the country so why should the entrance denied ....

  5. I read the other answers and to correct others there are no more Immigration Officers at ports of entry. They are now Customs and Border Protection (who may be legacy immigration). When you applied for your visa you were supposed to tell Department of State that  you overstayed last time you were admitted. Just because you have a visa does not mean you will be admitted into the US. The visa lets you knock on the door the CBP officer at the port of entry will be the final determination whether you are going to get a entry document or not. If you are determined to come here for your honeymoon, you will need to bring alot of proof that you have strong(very Strong) ties to  your home country, besides what you mentioned you will also need proof that  you live there and pay bills. For example, rent/mortgage bills, utility payments, etc. You may go onto the Citizenship and Immigration Services website for a specific list. You need to be honest with the CBP officer when you arrive at the port of entry. You will need to tell them why you overstayed last time you were here. Something to remember if you overstay again you will be denied entry and banned for life.

  6. If anything, if they deny your visa, make sure you've left yourself enough time to replan things!

    On the other hand, if they do deny your visa, I'd suggest trying to call or email someone there and politely ask if there is anything you can do to appeal or "correct" your past behaviour.

    Be nice! Being rude rarely helps people in this kind of situation.
