My old school (i'm moving out of the district but just wanted to know) had a rule against petitions, anybody who made or signed one would be suspended (thus nobody ever did) but, in the United States constitution, the first ammendment protects the right of petition (and assembly, relgion, speach, and press) i just wanted to know, can they leagally punish us and disallow us from petitioning? it's not like we would have caused a riot! my one friend started a petition to have more vegitarian options in the cafiteria and all she did was inbetween classes or whenever there was free time, try to get signatures, she stopped as soon as somebody told her she could get puinished. Thanks all!

  1. No the school can't stop you from having a petition but they can restrict you from passing it around during school hours.  You will have to take it off school campus.

Constitutional rights are based on the good of the masses, not just the individual.  When one refers to their constitutional rights, in the setting of schools, air ports, public areas, courts, parks, or anything that is funded by the government, then you fore go those rights in order to attend.

    At your school, I am sure that you know they can search your lockers at any time, your vehicle, your book bag, your lap top.

    When you walk into the halls of the building, you give up certain rights.

  3. No. The constitution promises certain unalienable rights. A lawyer could have very easily argued that in court. What your school did was wrong, and it's another case of Brown V. Board of Education.
