Can they fire me for this?

basically this girl at work just decided she wasn't coming back to work. i came in tonight (my night off, and very hung over from a reception) since she didn't want to work.she has been here for a year and is only scheduled to work 2 days a week, but would always call off so i'm TOLD i have to come in to cover for her. this happend at least once every other week and managment does know they just don't care as long as they don't have to come in. i'm supposed to be off tommorow also but they want me to come in so i can train a new person. i'm saying no. can i be fired for saying no when its supposed to be my night off? mind you this job is $7.00/hr, no benefits, no vacation, i have been here for 3 years and the only day i ever requested off was the day of my friends wedding.

  1. If they ask you to come in and you refuse, then SURE you can be fired.

    You say you only work 2 days a week normally.  Part timers usually don't get benefits, or vacation.


  2. Well I kind of doubt they will fire you because they won't have anyone to work. Just tell them you have to go out of town on an emergency. Then look for another job. A $7 an hour job with no benefits is not worth taking abuse for.

  3. can they legally fire you ..? NO.. but that does not mean they won't find another reason to fire you..

    If I were you I would find a way for them to NOT find me on my days off.  If they call you on your cell, DO NOT answer, and say you were out of range when they called.  Tell people at your house if they call there to say you are NOT home, do NOT answer the phone at home when you are home on your days off..

    If you are at work and they ask you to come in on your day off, find a good reason to tell them that you can't, have plans, no one to drive you on that day. anything that will work that won't come back on you..  

  4. It depends on your contract if they could.  I would start looking for a better job.  You're missing out on 4% of paychecks for vacations and at a rate of $7.00/hr without any benefits?  Find a new job, and quit when your position for new job is secured.

  7. Unfortunately I hate to be the bringer of bad news.  Yes they can fire you.  But will they?  that is the question.

    You can possibly fight it.  If you have an HR (Human Resources Department)  where you can discuss these matters, then you might be able to plead your case especially if someone else is calling in and taking days off that they were scheduled.  They dont need to give you paid vacations especially if you are part time.  As far as unpaid?  that is between you and your boss or HR etc.
