Question:

Can they know what has been smoked out of my bong and pipe? Read description..

What if I get searched by an officer and they find a bong and or pipe that has clearly been used before but there's no real evidence that in fact marijuana has been smoked out of there? Do cops have any legal power to find out somehow what was smoked in there? and is it also possible.

  1. Officers have the right to complete a field test on any bong or pipe that has residue in it. All they half to do is get a test kit from the patrol car and test it!  All officers have been to special training classes just for this. Our test kits have different test or all types of drugs. We test for what drugs we believe was used in them !


  2. Possesion of parifinalia is "reasonable cause" for search and seizure. The mere presence of the bong or bowl allows them to search the premises, or your car, without a warrant.

    If the bong is definately yours, and you admit to it, then they can easily smell it or take it to a lab for a swab test.

  3. The only way that you will be searched is if a police officer pulls you over/suspects usage of drugs, and/or smell it. Thats probable cause, therefore they have every right to find out if there is marijuana in there, if they dont smell anything then they have no right to check. If they find a bong, pray to god it's never been used with marijuana because not matter if you smoked out of it once with marijuana, and the rest with flavored tobacco, they each have a distinctive residue on it. Marijuana residue it sticky and smells like marijuana, tobacco you can just wash right off. I would suggest that if you have a bong or pipe, and are or did smoke out of it with marijuana to get rid of it, because only bad can come out of that.

    The drug paraphernalia can be tested by a lab to determine the substances that are 'burned residue' on the item.

    Personally, being a non-smoker, the distinct odor of burnt marijuana is something I can smell quite easily.

    I have dealt with a number of defendants over the years for just this thing. If I smell burnt cannabis residue (reasonable belief or probable cause in the US) I will charge the person for it. If the defendant pleads not guilty and it goes to trial, the bong which would have been seized as evidence, will be tested at a government lab. They provide evidential quality answer and are admissible in court.

    In short, if you've smoked cannabis in it you will be charged.

  6. If it has been used there will be residue. If it is marijuana residue they will be able to tell. However some municipalities have laws against possession of paraphernalia Sooooo... even if it has never been used and is completely clean you can still be fined and the bong confiscated.
