Can they make me testify?

I made a signed statement against my father at a police station. The police now want me to testify in court but I wont. What could happen to me realistically? - the case against him isn't very serious and even if found guilty he wont be sentenced to jail but it is going to the crown court.

  1. Theoretically, you can be imprisoned indefinitely, until you agree to comply with the court's order to testify.  Very very rare, but possible.


  2. If you do not testify,  they will put you in jail on contempt and keep you there until you agree,

  3. Laws differ depending on where you live, but where I come from if a witness doesn't show to the hearing the case gets dismissed.

  4. If you believe he won't be sentenced to jail, you should consider testifying. For several reasons:

    -you could be found in contempt, and spend time in jail

    -they may be able to make the case without you

    -the judge, and/or jury, may see your refusal to testify as intimidation by your father, which could make him look worse when it comes to sentencing.

    If you still feel strongly about it, you should consult with legal counsel.

  5. The prosecuting attorney could issue a subpoena to have you testify. If you fail to show, then you could be held in contempt and face penalties.

  6. To testify in court the court judge will issue a subpoena.  Failure to respond to a subpoena will result in comtempt of court.  Lying while in court is perjury.  Both can get you into trouble along with your father.

  7. YOU WILL BE SUMMONSED TO APPEAR AS A HOSTILE WITNESS AND ALL YOU HAVE TO DO WHEN QUESTIONED IS ANSWER I DON'T REC ALEC WHICH BASICALLY MEANS YOU DON'T RECALL ANYTHING HAPPENING. IF YOUR THE MAIN WITNESS THE CASE WILL BE DISMISSED
