Can they pay me less?

I went out on Maternity leave in March and when I called back to my job they wouldnt give me my position back and offered my one in a nother town. I told them that I couldnt do that and now they have offered me a job in the office where I was at! Its only part-time and its doing the front office work instead of me being the nurse in the back. They are wanting to only pay me 7.75 an hour instead of the 10.75 an hour I was making. Can they do this? I am not going to work for less then I was. I just want to know if this is legal or not! Please no smart A** answers and only helpful ones. I am stressed enough

  1. if you are in the US, yes they can do this....................

    you are protected on leave for 12 weeks IF you qualified for FMLA,

    by my figures you took much longer then that off.

    i hope that facts aren't considered smart as* answers and i know this is probably not helpful. they did more then they had to and tried to work with you, perhaps something better will come up if you take this otherwise brush up the resume'. nurses are needed everywhere so you should not have to much trouble finding work. good luck.


  2. Yes they can.  You have been gone more than 12 weeks, so someone else got your job.  Nice of the company to rehire and find two different placements for you.
