Can they prosecute someone like this?

A close friend of mine had some problems back in Las vegas, now they live in illinois, supposedly they commited fraud using the information of someone in Nevada, can they be prosecuted in Illinois? or expedited back to las vegas?

  1. I believe that they can.They can be charged with identity theft.I would think if the crime was committed in Nevada,then they would probably be expedited back to Las Vegas.


  2. If the fraud happened, or continued after your friend moved to Illinois, he can be charged in Illinois.  If the fraud was committed in Las Vegas, the state of Nevada CAN demand extradition.  If they do, Article 4, Section 2 of the US Constitution requires Illinois to cooperate.

  4. yes. and nevada likes to extradite they even have extraditable misdemeanors.

  5. They can definately be sent back to Nevada, but on top of that, most cases of identity theft are federal now. FBI jurisdiction is throughout the country, so the friend should first make sure that there arent any federal charges pending. If so, it wouldn't matter what state they moved to.

    If not, they could still be expedited if Nevada requested it. It would most likely not happen unless Nevada requested it, but if they do, it will be granted.

    The friend cannot be prosecuted in Illinois for crimes commited in Nevada. They may very well, however, be prosecuted by the FEDS or expedited to NV.
