Can they put him in jail? PLEASE ANSWER?

my friend is being accused of rape but he didnt do it. she wanted to something but he wouldnt. so now the bi**h is saying he and his cousin raped her. now he has to go to the station and everything. can they hold him and like put him in jail even tho he didnt do it?

his record is clean except he has 1 unpaid ticket, so can they keep him for that?

if they can, how long?

The courts follow the same burden of probability to determine whether some charged can be held or not.  That is, if the police believe he did it, then they will charge him and arrest him.  He will then appear before a judge in a "first appearance", and the judge will either determine that there is not sufficient evidence for the charge (not likely), or the bail conditions which will apply.  If your friend can post bail, he will be free until trial.  If he can't post it, he'll have to sit in jail until the trial is over.

they do have polygraphs and DNA tests, but he will probably end up in jail. going to jail for rape is not going to be fun for him.

unless YOU were with him when it supposedly occured, you have NO idea whether he did it or not.

I know a turned dowwn woman can be vindictive but I believe there is MUCH more to the story than YOU were told

She will need proof. If he is innocent, he will have no problem. He can even sue her for false arrest.

I believe they can keep him up to 72 hours for investigation before issue any charges.  He need to provide witness to proof he is not with that girl during the time she complain the rape took place.  The chance is he will get charge and may get out on a bail, than he will need to go to the court to proof his innocence.  Good Luck to him and his cousin, (only if they are innocence)

There are always 2 sides to every story, and as much as you care for your friend, in most cases, it's not ENTIRE story.  However,  Did file a report? Does She have a rape kit done?  Where there traces of s***n? Forced Sexual COntact? Bruising?  

There has to be more than just an accusation.  Yes, they can hold him for 24 hours for investigation, and can hold him if he as a warrant for the unpaid ticket, but she's going to need a whole lot more than just an accusation.
