  1. No, they can't. The only benefit that you might have is if your fiance is stationed overseas and you are willing to get married in YOUR country. If you are already married and your spouse is covered under the SOFA agreement (military or Department of Defense civilian) then you can go to that country under the SOFA. This takes a very short time. Of course, then you will need to go through the process of getting an immigrant visa (IV) to USA before you can go to the States (this takes about 4 months!).

    ** Added later... If your husband is stationed in the USA, then you should get the finance visa and get married in the States. A fiance visa should take less time than the IV.


  2. Roger is completely correct.

    Immigration and the military are two totally different things.  Military people have to follow the exact same procedures as non military.  All immigration petitions are based on the date filed.

    The only exception is for a spouse visa when you and your military husband live together in the same overseas country.  In this case your husband is allowed to file at the US embassy and does not have to send the paperwork through the National Visa Center in the States.  This cuts the time down from about a year to just a few months.
