Can u combine a short barrel rifle with a silencer

under the national firearms act, silencers and short barrel rifles (any rifle under 16 inches long barrel or under 28 inches total length) are both "title 2" weapons or whatever. both need approval from ATF to own, lotta paperwork, and cost $200 transfer tax or something like that.

so if i shortened the barrel on, say an AK47 with ATF approval, paid my $200 tax, then decided to put a silencer on the same gun, could i get ATF approval for that? also, do i have to pay another $200 for it? is it legal to have a combination of title 2 weapons?

  1. You must pay the $200 tax and file the tax form for both the SBR and the silencer.  They will be on separate ATF form 4’s (or form 1’s if you make them yourself).  The paper work is minimal, just the ATF form 4, 5330.20, finger print cards, photos and the $200 check.  It takes 1-2 months for approval these days.  

    Putting a silencer on a short barreled rifle is perfectly legal as long as the taxes are paid.  There is a way to do it with one tax stamp.  Take the barrel off of the rifle, cut it down then attach the silencer to it permanently.  If the silencer is attached with threads, then you can either use a high temperature (>1000 F) solder, or weld the rear end cap to the barrel.  Then re-install the barrel.

    ETA; With the permanently attached silencer making the barrel over 16 inches in length, the rifle is still a standard rifle and not a short barreled rifle.  So only the silencer needs a tax stamp.

  2. Two separate Form 4 transfers. Because each one has a unique serial number.

    Combinations are fine.

    You can have a registered .22 silencer and have as many firearms threaded to accept it as you like. IE: Ruger 10/22 and Ruger 22/45 pistol both threaded and swap the suppressor back and forth.  

  3. My understanding as well. You must pay and get paperwork for the short barrel and again for the can.

  4. I suspect you'll find that if you have already done your due diligence, and that the gun that the silencer is on does not have any bearing in the matter. If both class III items have been registered and the tax has been paid. You might want to contact a class III/NFA firearms dealer and get their opinion, but I think this is a pretty cut and dry case.

  5. Must have ATF paperwork for each.  $200 for each.  Seperate tax stamp for each.  You may combine on the same weapon.
