Can we cancel our lease?

My husband and I signed a lease back in November that will run out on November 30th. Is it possible to get out of this lease early or do we leagally have to stay here until November 30th?

  1. you can always leave, but you will still owe the rent thru November and you'll probably lose your security deposit


  2. You cannot cancel your lease.

    You can get out of it early by paying whatever the landlord will accept for terminating the lease. Otherwise, you remain liable until either the lease expires or a replacement tenant is found.

    You d not have to stay there, but will still remian liable for the rent until either the lease expires or a replacement tenant is found.

    Just because there is no security deposit does not mean that the landlord cannot sue you (win & get a judgment) for rent through November or until a replacement tenant moves in.

    The landlord can also hold you liable for any costs that he may incur due to your breach, such as advertising costs.

    There may not be a security deposit, but the landlord can bill you and sue for damages to the property as well.

  3. You aren't required to stay there, but the landlord is under no obligation to cancel your lease.  If you leave early, you can be taken to court for the months of rent remaining on your lease contract.

    A lease is a legally binding contract, and the landlord has every reason to expect and demand that same will be fullfilled as agreed.
