Can we get our money back?

We recently bought a home. We signed the papers on July 25. The central heat and air went out right before we signed and was told it would be taken care of immediately( It still is not fixed). We proceeded to move in. Needless to say it has been right around 100 F. We have 3 children one of whom is 3 months old and can in no way tolerate the heat. Our first night there we put in a 110 unit in one of the bedrooms to stay cool. It kept tripping the breaker. As of yesterday the breakers were tripped so much that it would not come back on. We have been forced to come back to the apartment we are moving away from. We bought the house as is and was told everything is in proper working order. The man we are buying from is paying to have these problems fixed, but is not in any hurry to see that it is taken care of. Tomorrow is the last day to have our power on in our apartment and I am afraid that our new home will still be without air. I want to get our money back and stay in our apartment until we find something else. With no list of contingencies in our papers I am not sure if we can. Does anyone know the legalities of the situation? Would we be able to get our money back?

  1. Go to the attorney that handled your purchase.  These problems should be covered in his/her boiler plate agreements.


  2. No, your not going to be able to get your money back. You bought the house as is with no contingencies. Get it fixed and ask him to pay for it. If not did you buy a Home Warranty? if you did call them and have them fix it. if he does not want to pay for it your pretty much out of luck.

  3. Contact a Real Estate Attorney.Sometimes that's  all it takes to resolve the problem
