Can you adopt....?

My hubby and i have tried for almost 3 years to get pregnant. He unfortunalty has a felony from years agon when he was stupid. anyway my question is, will that hinder our chances at adopting?

Depends on what it was for, how long ago, and the circumstances.

I have seen couples with a one time misdemeanor twenty years ago, like a DWI get approved.  But if the felony is against a person -- like assault, --- or if it is for child abuse, rape, drug dealing, etc., then no, you will not be approved.  And, each agency and each state has their own ruling on this issue, too.  

There are WAY too many adoptive parents with no arrests what so ever to choose from, so unlikely a birthmother would choose one with a felony anyway.  This information will be disclosed to the birthmother, just like her arrest record is disclosed to you.

Sorry.  Our past does come back to haunt us sometimes.

It could in the long run.  Your best bet is to go to an Adoption Agency or to a lawyer that specializes in adoption and honestly tell them that your husband has a felony on his record from years ago and see what they say and/or recommend.  It will probably depend on why he was arrested.  They will not place a child in a home that they won't be safe in.

Adoption is a long and hard process and most people handpick the parents they want for their unborn children, so the fact that he has a record could look bad on him, if you are willing to have an older child you might try foster care first.  I have 6 brothers and sisters that were adopted thru foster care and at one point I was also a foster parent.  My mother fostered my younest sister from the age of 6 months old and she was finally adopted at  the age of 4 and it was  the greatest thing that could of ever happened to us.  So many people want to go out of the country to adopt babies but there are so many kids here in this country that are waiting for their forever families.  Please look at foster care in your state and maybe soon you will have the family that you have always dreamed of ... oh btw... my husband had class D felonies on his record and he was ok'd by the state to be a foster parent with no problem.... so best of luck to you and hope that you look into fostering the kids in your state!!!!

That has a very real chance of causing you some problems with the adoption process. Adoptive parents go through lots of screening processes. It couldn't hurt to talk to some agencies and hear from them directly how it could impact you. Different agencies could have different requirements, also. Good luck!

I dont know the law but i know that a guy i know has a felony against him. While he was in jail his mother adopted his newborn son. ( the mother didnt want anything to do with the baby) Now he lives at home with his mom and son and he can not permission to adopt his son.

Without knowing what he did, it would be hard for anyone to even guess at this one. Your best bet is to call around to local adoption agencies. They may have different requirements. If you're up front with them, you may have better results.

Every state publishes a list of offenses that automatically bar people from adoption.  Most of these are felonies relating to weapons, children, violence, and s*x.  If his felony IS on the list and you both really want to adopt, you can have an appeal hearing before an arbitration panel.  Bottom line, having a felony on your record does not necessarily mean you cannot adopt.  Call a few local agencies, and see if they can provide you with information about whether your husband's felony is on the list.  They should be able to help you with this before you sign up with them or pay a deposit.

absolutely not if you go with a good agency and are honest from the start.  they will find out when you do a criminal check that is required.  everyone makes mistakes, relax and start the process.  if one agency doesn't work try another.  international adoption is also a possibility and easier than you think
