Question:

Can you be arrested for drug use/possession for admitting said use to a cop w/o there being evidence?

If a cop questions you regarding drug use/possession and you tell them "yeah, sure I was doing drugs," without any physical evidence that you have been doing drugs (other than maybe someone giving them an "Anonymous Tip" or they "suspect" you of doing drugs) Could they legally arrest and/or charge you for any crime? Again, no physical evidence... so if the cop says..."ok...so were you doing drugs in the bathroom? Just tell us and we'll leave..." can you just say "yeah, sure, I was," just to get them to leave you the f*** alone? (Even if you weren't) or even if you were and everything is gone.... I guess I am really just looking for some clarification on the law...

  1. what state do u live in? Cops can basically do what ever they want. so they think, esp. the arrogant ones. there may be repercussions to their actions but they can initially do whatever. That was a realistic answer for where i live in Bx NY but.... there is no evidence for a conviction ..again doesn't mean you can't be "detained by police" for 48 hours then released if they wanted to but your chops.

    If you just want to answer them so they will leave might as well say no, why make yourself look guilty of something? I


  2. In my state you can't be charged for admiting to drug use without some sort of evidence.  I ask people all the time if they do drugs and many of them will admitt it to me.  

    However, you can be charged with a number of other crimes.  For example, if I see you standing on the side of the street yelling at passing cars and I get out with you and talk to you and you seem stoned so I ask you if you'd been doing some sort of drug and you tell me you have then I could charge you with Intoxicated and Disruptive.  The evidence would be your stoned appearance, your admittance to doing drugs, and your causing a disturbance on the side of the road.  I can also charge under age people for drinking under age if I smell alcohol on their breath or they register a positive reading in an Alco-Sensor.

    Some states have laws that make it illegal to be under the influence of an illegal substance.
