can you be charge for a dwi in the state of new jersey and your not driving the car and your the passenger only yet you were the passenger and new the driver was or was not drinking ?

  1. Not DWI, no.  The non drinking driver is what law enforcement calls a "designated driver" and very much encouraged by law enforcement.


  2. DWI means DRIVING while intoxicated.  If you are not driving, how can you be guilty of DRIVING WI? Are you serious or just drunk?  Can I be charged with murdering my wife when she is not dead?
