Can you be forced to bail yourself out without any charges filed?

Christian Bale is an example. They don't have enough evidence to charge him for assult but he had to post bail. Is this possible? If So why?

  1. In the United States, if you are arrested, but the charges are being reviewed, you will have to post bail or an OR would be issued by the Court until the District Attorney reviews the case.  If no formal charges are filed, the bail will be returned.  If they are filed, you will scheduled for a preliminary hearing.

  3. In the U.S. if no charges are filed then the person is released.

    There is no bail required if there are no charges.

  4. There is a difference between an arrest and formal charges being filed. If you are arrested then you have to post bail. The case is reviewed by the DA's office and there may never be formal charges filed. The bond will be refunded.
