  2. There is a dependant eligibility test with 3 points

    Age, Relationship, and income. A child under 24 yrs, in school and make less than 3300.00, or any age and disabled.

  3. If the person is your spouse, then file a joint return and claim the two kids.

    If the person is NOT your spouse, it's a little more complicated, but if they lived with you ALL year and you provided over half of their support, you can probably claim them.  You can't get the child tax credit for the kids though, or file as head of household.
