I hurt my shoulder at work and am currently working 4 hour shifts and collecting workmans comp for my loss of hours. My dr wont listen to me when I tellk him that even the 4 hours are making my shoulder worse so I was wondering if workmans comp will still pay if I take a leave because of my shoulder that my dr didnt put me on

  1. only under the care of your dr,  if he say,s you work you do,  other wise, if he put,s you out,  then you can still draw. good luck kiddo!

  2. Get another doctor.

  3. In a way the doctor is right and it does make sense.  He's placed you on modified work restrictions.  Your work restrictions are no use of your right arm.  If your job is accommodating for the injury, such as sitting at the desk and reading magazines than they have every right to do that.  Technically if you take yourself off work you'll only get paid for the 4 hours lost.  If your work cannot accommodate for your work restrictions than you will get your full temporary total disability (TTD).

If you feel that your other arm is starting to hurt than talk with your employer regarding the issue.  They are the only people that can accommodate your restrictions.

And if your questioning your doctors ability you have every right to see a doctor.  You will have to ask your adjuster regarding rules on how many doctors you can see, or transfer care.

You can't time off and walk from the job, that could be considered as job abandonment.

  4. No.  Your doctor has to declare you unable to work.
