Can you evict a room mate shared on a lease for not paying their share of the rent ? ?

  1. the h**l yeah!!! If I were you I'd put his/her stuff outside the room until she returns with a big sign on the door "Share or Get in, Don't You Dare!"


  2. NO - ONLY the landlord/ Property owner can evict anyone.  and then they are more likely to evict all of you because you are all equally responsible for the rent in the eyes of the law.

  3. No...but you can take the non paying roommate to court and sue for their share.

  4. Yes, the law protects you whether or not they have signed a lease.  They can not live for free.  Pay $35 at Small Claims Court.  You will have the trial in 25 days.  If they pay in full, they can stay. If not, the sheriff escorts them out.

  6. If you are an equal roommate on the shared lease, no, you cannot evict them.

    If it is a shared lease and the landlord does not receive the full rent payment, the landlord has no choice but to evict both roommates.

    if not, contact the Judicial Branch at your county/parish courthouse

    and you can file papers to get them evicted in a few days - but they must

    be 'served' and it will cost a small fee

    ask them anyway - they probably know the answer either way

    so sorry - my son;s 3 roomates just up and moved out

    his was the only name on the lease - so he left, too

    and that has haunted him for 7 years

  8. No, you can’t.  Only the property owner can evict someone.  Everyone who signs a lease is agreeing to pay 100% of the rent. If she can’t pay, you have to pay it.  If you don’t, you can both get evicted. It’s a risk of living with someone else.
