Can you file Chapter 13 on bad check

Some one wrote a check for materials to the company i work for they are sending us Chapter 13 papers. Is this possible. It is couple thousand dollars which would be felony in GA.(Right?)

  1. Maybe there’s some other Chapter 13 of which I am unaware, but I always thought the term referred to a type of bankruptcy – which is something you would choose to file. Another company isn’t going to file for you.  Are you sure it's Ch 13?

They have filed Chapter 13 bankruptcy and are including the money owed to you in the plan payments, meaning you would get minimal dollars for the amount of the bounced check unless it was a secured debt. The chapter 13 paperwork they are sending you is a claim to send back to the courts stating they in fact do owe you money. If the debt is unsecured, you won't receive the full amount of money owed. You'll receive the paperwork and it'll explain what to do. Good Luck!

    To add to that...once they file you can request a case#, and by law cannot pursue any legal activity against them as they are protected by the bankruptcy laws.
