Can you file bankruptcy in Ohio without losing your house and car? Basically I got into credit card trouble!

  1. If you qualify and file for a Chapter 7 bankruptcy, it may not save your home and you will lose your car unless you are able to reaffirm that debt.  If the car is paid in full, you will probably lose it.

    With a Chapter 13 bankruptcy (wage earners plan), you can keep your house, but you have to pay some or all of your debt over a five year period.

    Before you call the bankruptcy attorney, go to www.nfcc.org and find out about your credit counseling options.  You'll have to go through credit counseling in any case; it is required as part of the bankruptcy filing process.
