Can you file for divorce without the other persons signature?

I need to file for divorce, but I cant trust that my husband will do anything when I send him the paperwork. This is just how he is. We have no communal property, money, children, or anything to fight over. How would this work?

  1. nope, ONLY if after repeated attempts by the court, ...and you have a court date and he has been physically served, he does not show up, you will be granted divorce

I assume you live apart and in the same state--regardless, follow the laws for your state, or the state you were married in and file for an absolute divorce (uncontested) and when you do, a copy goes to him and one to the courts and he has the choice to sign or not. If he does not, in Maryland, it becomes final in a year anyway...not counting the year you have to wait living apart prior to filing. Check a lawyer or the local court should have a packet you can follow and purchase. I did my own uncontested divorce and it only cost $110...as opposed to hundreds a lawyer will charge. Good Luck.

  3. If he is given the paperwork but doesn't sign it it simply means he has nothing to contest with in these cases the judge would simply honor the divorce and give you back the freedom you want.  If your not asking for anything then there is really nothing but ending the marriage to deal with.

  4. The courts will everything within there power to serve him a notice of the hearing. If he don't show up it's all yours granted you got your divorce.

    Maybe different in your state. Ask your attorney.

  5. I'm going through this now.  You file, he's served.  He has 30 days to respond or whatever you filed is it.

  6. It doesn't matter that you don't have anything to fight over, you would still need his signature to show that he accepts that you both want a divorce. The marriage certificate is a legal contract, that both parties need to sign in order to end the marriage. The only way that you wouldn't need his signature is if your husband was extremely abusive to you, then you would have to go to court and have a judge decide to your favor to grant you a divorce.

  7. I don't know how it works where you are but in England if you have been separated for 2 years yes you can.

  8. get beaten up then file the papers.  send a floozy to his house and catch him.  

    just take the paperwork over there and make him do it like homework.  claim to the judge he won't do it cause he wants your life insurance.

    theirs are better.
