If someone is at a party and they are 18 years old but they aren't drinking, can they still get in trouble? And if so, does it vary by state?

  1. As long as they don't get caught.

  2. I'm Guessing that you are talking about a 18 yo in a club that is only for 21 and up. if that is the case i don't think that the 18 year old will be in trouble unless she/he has a fake id on them if searched. (stolen identity)

the club will get in trouble for having a under aged person in the club or bar if they are drinking or not.

it might be different in some states but you would think that it would be everywhere.

  3. As long as no one at the party under the age of 18 is drinking they should be fine.

  4. if there are minors drinking alcohol & there is anyone 21 & older they can be arrested for distributing to a minor. yes it does very from state to state.

i.e. in Michigan, a person 18 and older can drink alcohol, wine, beer, ect,

  5. they are going to smudge your sainthood as fast as they can-just own the LIMO

  6. is everyone else over 18? if not and there are people under 18 drinking, then yes, they can be charged with contributing to the delinquency of a minor, even though they are not old enough to buy alcohol themselves.

  7. It varies by state, so check your local laws.

Yes, the minors can be charged, but that doesn't mean much without a conviction.  Best to submit to a breath test right away to prove you have not consumed alcohol.
