My husband had a petition filed for him by his mom, which was approved. On it, there is no A-number. When we went to immigration, they gave us his A-number. Our immigration counselor insists that he cant have an A-number from an approved I-130, or else it would have been on the approved petition, so something else must have been filed. Therefore since she believes something else must have been filed, she wants to pull up his file from national records....which takes 2 YEARS! ADVICE?

  1. First of all, you have to understand about Family petition.  Priority will be given out by FP-1 citizen's unmarried children who is over 21 yrs old, FP-2 green card holder's spouse and under 21 yrs old children, FP-3, married sons and daughters of citizen, etc.

Based on the following link, the visa bulletin of FP-3 married sons and daughters of citizen June 15 2000.  If his mother filed him the date before June 15 2000, then congratulations, he can file I-485 to get work permit, advance parole, a-number etc.  If not, you have to wait till that date coming.  This visa bulletin will post on every newspaper once a month.  Or you can follow the link to there to check it.

  2. Actually these days an A number is automatically assigned when the petition is approved. It's something relatively recent. It won't hurt to ask for the records, but if he's never applied for anything in the past, it probably won't help much either.
