Can you get arrested for being high?

Question

like lets say i wanna go to the local grocery store. I'm not driving a car or anything like that, basically you can tell when I'm high from my red eyes, giggling for no reason, a bit of balance loss, a bit of memory loss[aka; "what where we talking about/what did I come here for again?"] and sometimes I don't know what's going on so I'll and say something that has nothing to do with the subject. Oh and throw in the fact that every time I smoke I think I can hear my heart beat, and I get really sleepy when it starts to wear off.

p.s. I know I listed mostly the negative effects, please I don't wanna hear your opinion on smoking .

Yes.  

If the police decide you are a danger to yourself or are unable to care for yourself they will charge you with drunk in public, public intoxication, etc( depends on the state).  Then they will put you in jail for a few hours until you can take care of yourself.  

The police are just as concerned with the safety of people who make bad decisions as people who make good ones.  The arrest is more for your safety than as a punishment

Yes you can get arrested because it's no different than being intoxicated in public, which puts the public in danger of something you may do or something happening to you - not safe, considering your judgement is severely impaired. It's kind of like not wearing your seatbelt while driving - you can argue so what, it won't harm anybody else - but nobody wants to be held accountable for liability should they get in an accident with you and you get severely injured. Another obvious reason is that you will be under the influence of an illegal substance and can go to jail for it especially if you test positive for drugs you don't have a prescription for from your doctor, kind of like if someone under 21 is caught intoxicated or with alcohol - they're not supposed to have it by law so of course they will get cited and fined. An additional danger is that if you are alone in public and are high, chances are people will notice including a dangerous person who will realize you are not very alert and your guard will be down, they can harm, mug or assault you.

haha you could but you'd have to be pretty f**ed up to be caught.  try visine eye drops for the redness. play the giggling off as just being happy. and if your a little "slow" whatever blame it on no coffee this morning. all in all your going to be fine nobody will really know or wont say anything at least. however your friends might nail you on it because they know what you look like when your high.

but there are states where its legal to smoke and carry a certain amount of weed, with a medical card. so perhaps in those states if you have said card you can be high in public, but dont quote me.

What kind of stupid question is this? Let's see, hmm, marijuana is illegal, and the usage, growing, selling, and keeping of it is illegal, so YES it is illegal. You can be arrested. All it takes is a urine test.

depending on the state it could be public intoxication, being under the influence, being under the influence of narcotics, bodily posession of narcotics (yes, they charge you with possession and being high b/c its in your system)... the exact charge varies by state... but yes.

In some states, you can be arrested for being under the influence of a controlled substance. I know in the state of Nevada, they have a law that is called "Internal Possession." Depending on the results of a drug test will depend as to how much trouble you will be in. You get sleepy because the euphoric feeling of being High is wearing off. It is your body's natural defense to rest after being high or drunk. Eyes turning red does not mean that you are high or have been smoking.

So, YES you can get arrested for being high and acting the way you do when you are high. We used to tell people like you. "Maintain or Move on."

nope cops arent looking for that they are looking for drug dealers and if they catch you smoking they will take it away they usually dont fine you.

i dont see why people are saying yes if a cop asked you if you have been smoking you say no its not like when your drunk its just common scence
