Can you get convicted of a misdemeanor for theft if you stole a wallet but returned the money?

I didn't steal the wallet, however I was the last person to see it and touch it. On camera it is sitting by me and once I move you can no longer see the wallet. A man lets the business know that the wallet is missing. After reviewing the tapes, you clearly see the wallet by me and once I move it is gone. I do not know what happened to the wallet, however, I agree to give back the money when I'm told that it is $200. I give back $200.00. Can the man whose wallet was stolen press charges against me, even though his money was returned? His credit cards and anything else left inside the wallet are still missing.

  1. Yes, you can still be charged.  

    The wallet still has a value. In addition, he will have to pay to have his drivers license replaced. There may also be pictures and other items of value in there.
