Last month I got pulled over for a DUI in Los Gatos, CA. I smoked marijuana earlier in the day and am wondering if I will be getting another charge added onto the alcohol related DUI. The cops took my blood and I just want to know if they were testing for every drug out there or only verifying my BAC? I was not stoned at the time when I was pulled over, but I definetly did have it in my blood still. Please, only serious answers only.

  1. Yes, you are in trouble, driving with drugs in your system in another charge that they will hit you with.

  2. If you smoke marijuana on a regular basis it will stay in your system for as long as 45 days, and if you smoke marijuana at a constant pace, it can stay in the body for 90 days.

Marijuana is fat soluble. It stores in the fat cells of the body, the brain, the liver, the kidneys, in other words the major organs.

  3. Unless you're a regular smoker it will only show up in a blood test for a few hours after smoking.

  4. It's best if you talk to a DUI attorney.

You can request a FREE DUI case evaluation with a local attorney at

  5. I am not sure, but more often they use a urine test for marijuana.
