  1. lol no.........just dont make it turn into harrassment.......and dont say "im gonna kill you" cause that is now considered a terrorrist threat

  2. no

  3. In the State of Texas, and most other states, it is illegal.

    It's called 'Disorderly Conduct-Language'.

Class C Misdemeanor, $500 max fine.

  4. All depends on how you approach the person with the cussin :)

  5. you can be taken to jail for the misdemeanor section for obscene language in a public place committed in the presence of the officer if you dont stop when they tell you to.

  6. No. Not unless you live in a small town in Utah or something like that anyway.

There are no laws on the books that say you can't curse at someone or call them names or anything like that. Don't let anyone ever tell you different. All the Cops would be able to do is try to peacefully calm the other party down, calm you down and try to resolve things well enough so that the 2 of you don't do something they have to arrest you for. Now if it gets into something physical or leads to threats of bodily harm or death.....then they can get you.

  7. Yes, you can, this is called Verbal Assault, if any threats were made, or if you said something slanderous in most states they have adopted this.  Or if you spit on the person while cussing them out then that would be elevated to communication of a threat, as well as assault with a bodily fluid.

Assault is where you harm someone and they feel pain, or adverse reaction to that.

Now, the things that commonly occur with cussing someone out, would be disorderly public conduct, or lewd behaviour depending on the circumstances.  If you touched the person you were cussing out or they touched you while they were cussing you out or if they touched you while you were cussing them out, then this would be classified as assault (simple without bodily injury). Now if they felt pain, then it would be assault with Bodily injury and the stakes are highter.

lets review the whole domestic scene in this. If your wife is cussing you out in the face and you stand up to push her back then this would be assault on spouse which is a domestic voilence charge and then you would be getting rid of all your weapons and guns and would no longer be able to even pick one up, or touch ammunition and such materials for the making of ammmunition or explosive devices.  (see lautenberg amendment).  And the assault doesnt have to happen on your spouse, it could happen with your parents, a brother or sister, or someone that lives with you at the time.  It is domestic, and does not bear a loophole for just friends, if they live there and recieve mail there than that would be domestic violence.
