Can you get married to someone in the army if your illegal?

im not asking for people to criticize my immigration status, Ive been living in the US for 14 years and I do consider myself in some sense american considering ive lived here more than I have in my home country, its more of a home to me than mexico. My boyfriend is in the army and we want to get married, we really love each other and we want a chance to be together.

  1. You can certainly get married. But that alone won't affect your immigration status in the US. If you entered without a visa, then you won't be able to become a green card holder without leaving the US. Your husband would have to file an I-130 immigrant visa petition for you, and it would take a year or so to process and approve, but it would have to be sent to Ciudad Juarez for an immigrant visa interview. Sice you've been living here illegally, you're currently ineligible for a visa, but you would be able to file for a waiver through USCIS which also has an office with the consulate there. Assuming your waiver is granted, you'd be able to return and get a green card after your entry. If the illegal presence is your only immigration problem, chances are quite good you'd get the waiver. On the other hand you could continue to live in the US illegally as his wife, but it would greatly complicate things for the two of you, when he moves from one assignment to another and you would always be subject to deportation if you were picked up by immigration for any reason.  But, although it will take some time and cost some money, it is possible for the two of you to legalize your presence here and live together. For you to marry a serviceman, being an illegal alien, would jeopardize your boyfriends service record.  He could be kicked out once it is found that you are an illegal alien.  He would be going against the laws of the country he is supposed to be defending.  A dishonorable discharge he would carry for the rest of his life.

    You really want that for someone you supposedly love?  You need to return to your own country, and then have him apply for you to return.  You can't make legal out of illegal.

  3. I believe that you can. Your husband can surly find out. I hope things go well for the both of you. I wouldn't worry about the negative remarks on here, it's just some people have a problem with immigrants. They are the fool though.I'm Native American and believe all (ancestry) came from somewhere other than here and we all need to work it out! Because we are here to stay.
