Can you get petty theft for breaking into a house? if so how is that even possible? just wondering because I know some one who is claiming that they only got petty theft for two different home burglaries

  2. petty theft is putting a candy bar in your pocket and walking out the store.

    Breaking into someones house is called burglary  unless they worked a deal with the DA's office and got it reduced.

  3. You would be hit with a breaking and entering charge, not petty theft.  Petty theft is stealing, i.e. shoplifting items less than $20 in value.  Anytime you break into a home for purposes to rob the place, that's burglary, big difference.

  4. They may have pleaded guilty to petty theft in exchange for dropping a breaking & entering charge.  Especially if the evidence involving them was not airtight or if the value of the items stolen could not be confirmed.

  5. More than likely, the prosecutor lowered the charge for a plea of guilty by the offender.

    this is definitley burglary! this charge is a felony and cannot be knocked to a misdemeanor at all.

  7. Its called "Breaking and Entering" and you can go to jail, get a felony, plus be fined a lot of money.

  8. no its not petty theft if your break into a house thats BandE way more worse, petty theft is at a store less than 500.00.
