  1. All these records are public.  All you have to do is go to the courthouse and request them, they will charge you for the copies.


  2. Researching,  I have viewed many wills (and probate files), all of which are public documents.

    Here is the only catch.. if you mean a CURRENT will, that is recent, it is possibly still in process, and won't be finallly recorded. Any will of someone who isn't dead yet, isn't even into the system.

Why bring in Right to Information Act in all cases when this relates to Public Documents which already open for inspection by following a proper procedure in short period of time (same day) rather going for application under the RTI Act & wait for one month for the reply. If probation & issue of letter of administration was applied with regard to the 'Will' in the Indian Court, & any order with regard to this passed by the Court, you can apply to the court for inspection of the case file & get an order for the same. Inspect the whole file, see what all is stated in the 'Will' & order pertaining to its Probation etc.

  4. A will is a legal document.  A probate is a process whereby the court  "proves" the will.  Probate court records are public records which are open to anyone willing to go to the Courthouse or Hall of Records and look at them.
