Can you give me an estimate on how much I will receive for my motor vehicle accident?

I totaled out my Dodge truck when a 16 year old kid ran a stop sign. The kid was written two citations. When the air bag deployed my left arm was already in front of my face. At this time the air bag hit my arm. I eventually had surgery on my shoulder due to the accident. It was a major surgery and I was put under. I have signed up with a lawyer but just after talking with the insurance company. They would not give me any answers. Thanks

  1. In most cases of personal injury there will be physical and mental pain and suffering. Physical pain and suffering may include but is not limited to bodily suffering or discomfort.

    Mental pain and suffering may include but is not limited to mental anguish or loss of enjoyment of life. If you suffer physical and mental pain and suffering after an accident you can recover for both physical and mental pain and suffering from the date of injury to the present time.

    If there is medical testimony that you will suffer from future physical and or mental pain and suffering you can make a claim for this item of damage as well.

    Sometimes injuries sustained in an accident are significant enough that you will lose the loss of function of your mind and/or body. If you suffer the loss of the funcion of you mind and/or body as a result of an accident you can seek recovery for that loss of function both for the past and in the future.

            

    The amount that you are entitled to recover for physical and mental pain and suffering, loss of future earning capacity of loss of function of the mind and body both in the past and in the future cannot usually be measured by any exact or mathematical standard.

    In cases where these items of damage are suffered the jury will be told that they should use their sound judgment based upon the evidence in assessing the amount of recovery for each of those elements of damage.


  2. The insurance should have already paid you for the truck.  That's handled separately from your injury, usually.  What did your insurance company say about it?  Sometimes they can motivate the other person's insurance company to pay up.

    The lawyer will take a third of what you get.  He will ask for a lot, the insurance company will offer a lot less, they'll go back and forth and eventually they'll reach an agreement on an amount and  you'll get paid.  It could take up to a year, though.

  3. historically the ins. co's first offer is 1/3 of what they will settle for. you have major injuries and need a good lawyer, lawyers also deserve to be paid for their services.

  4. swing for the fences you need to get a new truck, lost wages, quality of life  cuz shoulder injuries suck  sue'em get something with enough zero's and comma's that  makes you feel better
