Can you legally tell me they can or cannot bred the puppy you sell to them?

I don't have any pups i am selling I am just curious. Some breeders say you can and other breeders say you can't tell people what to do with there animals

  2. Reputable breeders have legal contract with the homes they sell their pups to.  They usually give them a certain time when it must be done and tell them to send a copy of the spay/neuter certificate.

    I work in rescue and when we get pups in that are too young to fix, we do a spay/neuter contract and give them a date and if we do not get the certificate from them , we take the dog back.  It is a small step in trying to control over population by back yard breeders

If there is a contract, which any responsible breeder would insist on, and there is a spay/neuter clause, which ANY responsible breeder would have, you are in breach of contract if you breed it, and can indeed be sued.  I would refuse to sell a puppy to anyone I felt would not honor my contract.

  4. yep, abbyful is absolutely right. a breeder can have you sign the purchase agreement having you agree to have the dog spayed/neutered and sell it on a limited registration which means if you were to breed it, you wouldn't be able to register the pups. so, to answer, yes it is legal for them to do that.

  5. Yes you can - this is why most breeders sell their pet quality animals on a limited registration and do not release the AKC or UKC papers until they have gotten proof the animal has been fixed.

    Other sell the animal on a spay neuter clause in their puppy contracts and like any other contract if you break one part the whole thing becomes null and void.

    Others just sell pet quality pups already fixed.


  6. If a breeder doesnt want someone to breed one of the animals that they sold then they should make sure the animal is fixed before they sell it. If not how would they know anyway if the animal had pups or not?  

  7. Definitely not illegal to breed or sell puppies that I'm aware of.  In many cases it can be considered immoral however.

  8. Yes. They can have a legally binding contract that requires you to have the dog spayed/neutered within a certain amount of time, thus making it so the dog cannot be bred.

Yes, a breeder can legally controll the future breeding of a dog by a signed contract between buyer and seller on the date of the sale.  A few years ago I sold a puppy on a neuter contract stipulating a particular date by which the dog had to be neutered.  The microchip number was recorded in the contract as well. The date passed, and my attorney contacted her to advise her that if she did not provide proof of the neuter of this puppy within 7 days, he would file court proceedings for breech of contract in the amount of $10,000.  Proof from her veterinarian arrived confirming that that particular dog was in fact neutered.
