Can you make the CSA uninvolved once they have become involved?

If a person cancels their income support claim, will the CSA remain involved? If yes, can you request they stop, and let you handle it yourself?

  1. If you ask them not to help, they will cease to do so.    

    It may take time.


  2. No, because the CSA is an involved 3rd party (acting on behalf of the State) and not controlled by the custodial parent.  The only way to dis-involve them is to go to the court and say nothing is owed.. then the state has no interest and it drops out.

  3. Once the parent with care (PWC) is no longer claiming benefit then they are a private client of the CSA. Once that happens then the PWC can request that the case is closed or the case be suspended (so it can be reopened if the non resident parent doesn't pay etc.)

    Any arrears accured whilst the PWC was on IS would still have to be paid, but any arrears due to the PWC when not on IS can be written off or put on hold if the PWC so choses.

    The CSA can only take direction from the PWC, so the case must be closed by them and you have to get paper confirmation that the case has been closed or suspended.

    If you are paying direct to the PWC, then pay using a Standing Order which states Child Maintance. Many have found this very useful if the CSA reopen the case.
