  2. It may be an "urban legend" but I have read that if you can demonstrate that it works, you can patent it. With most patents you don't have to actually build the device being patented, you just have to describe it well enough that someone "skilled in the art" can duplicate it, but with perpetual motion you do have to show a working model -- which is just a long way of saying NO you can not patent a perpetual motion machine, since you can't actually make one work.

    If you have invented a toy or novelty that _looks_ like a perpetual motion machine (but is not in reality) you could patent that  as a novelty (if it meets the other requirements for a patent)
