Question:

Can you put a provision in your Washington child support order for annual expenses?

Recently, I asked my ex-husband how much he could afford to contribute to his daughters school clothes and supplies, his response was "that is covered in my court ordered child support."

I do not agree, as that support is calculated based on the basic needs of the children without taking into consideration the expenses that occur only once per year.

Does anyone know if a provision can be added to your Washington child support order for this annual expense?

  1. Sorry, but I have to agree with your ex.  Unless the child support order specifically states, he is not responsible for any additional expenses.  It's up to you to budget for those things out of the support he already provides.

You could try to go back to court to get a modification, but the Judge is likely to say that those things are already taken into consideration.  If the support amount was calculated based upon a percentage of his income, it would hardly be fair to ask for something above and beyond- especially if it's for a normal expense such as this.

I know it's not easy raising a child on your own.  Hang in there, you'll find a way to make it work.

  2. No, it can’t be added, because he’s right...his child support includes clothing, school supplies, etc.  It would be wonderful if he contributed half of these expenses (assuming he can afford it), but that would be strictly voluntary on his part--you cannot force him to.

  3. It is normal for a child's expensives to increase as they grow. Be businesslike and keep record of all expense and present worksheets to ex. If he still ignores, then go to your state's Child Support Calculation - google it_for you state and re calculate from that formula. It would be very helpful if you knew he were making more money than when the CS papers were drawn up, especially if it was a few years back. The you will need to submit paperwork to increase CS. A few calls to local lawyers- many offer 30 minutes free advice- check yellow pages and bring all your documentation.
