Can you "fire" your real estate agent?

We had a real estate agent take us around to view homes for sale. We found the house we wanted to make a offer on, called to make a appointment to see it and all our agent did was accompany us on the home tour and then email us the offer paperwork. He gave us incorrect numbers and figures in our offer, we are basically $2500 short on the deal and the selling agent has asked that he come out of pocket since it was his mistake in the original figures. Our agent is not returning phone calls and being blaming others for his mistake instead of owning up to it. We dont want to lose this house! Is there any way to legally fire him without being sued?

  1. I agree with notification in writing to both the Agent and his Broker.

    If you did not get at the least a new agent, I would then contact in writing their Board of Realtors.

    If the Agent and Broker do not care - then the Board will Care.

    If this does not work - then go to the other Agent and Broker, they may jump through hoops for you ( they would not want to loose deal).

    Last resort - local TV staton........................

  2. Nope, not if you signed a buyer's agency contract.

    First, do take responsibility that the final figures written on the contract should have been verified by you.  If they were not correct, then you should not have signed before they were.

    There is a way for you to get the house and not fork out the money.

    Call his supervising broker in charge...legally, THAT is who your contract is with.  Tell him you have an agent that has apparently abandoned the transaction.

    They will assign another.

  3. Have you talked to your agent’s managing broker? Explain to him what’s going on and ask for help in resolving this.

Absolutely!  We have fired a few of them.  There are way too many agents in this world to put up with someone that doesn't work hard for you.  Call your Board of Realtors, hopefully you have one, and explain this to them.  We have also called the real estate office that the agents worked at,and asked to talk to the owner.  You should sign a paper of some sort, to release you from the agent that you are working with.  Good Luck!

  5. ABSOLUTELY!  I just finished my Board of Realtors Orientations and yes, you can fire him!

    First step for me if I were you would be to call his Broker.  The broker is responsible for his license.  Insist that you get another Realtor to represent you and insist the the Broker make him pay for the difference.  If this is not resolved, write the Board of Realtors, ss the broker and send the Broker a letter that because of his failure to supervise his Realtor and because he has not addressed your complaint in a favorable manner, you are filing a complaint against him and the Realtor with the Bord and include a copy of the complaint.

    That is what I would do.  See if you don't get your issues addressed....and fast!

  6. Your contract is really with the real estate broker. The agent is his representative.

    Do this: Call that agent's boss and let him know that a deal may fall through because of this agent's ineptitude. The agent's boss is the real estate BROKER, the person who can make the decisions.

    If you do not get satisfaction from an agent, go straight to the broker! And tell the broker you want another agent assigned to complete the deal. Leave it to the broker to decide how to split the commission.

    One fact puzzles me: Just how are the numbers incorrect? How can you be short on the deal? It sounds like you are in the offer stage. Either the seller accepts your offer, or does not accept it. In that case you make another offer. Why do you think your agent owes $2500?

    If the offer was in error for fees and such, then have the broker rescind the offer before it is accepted, and make a new offer.
