I was watching the People Court on TV this morning and saw a case where an individual involved in a dispurte with another recorded their conversation for proof that a verbal agreement had been reached between them. The other party tried to say in court that there was no verbal agreement made, but the tape proved it. So, my question is; Is it illegal withing the state that I live - Ohio - to record a private conversation where the other party does not have any idea your recorded it? How can I find such legal information?

  1. Yes, in Ohio you can record a conversation you are participating in.  Even if the other party has no knowledge the recording is being made.  Ohio is what is called a "single party State."

You MUST be a participant in the conversation; if not you could be charged with wiretapping (a felony).

  2. Ohio state statute allow one party consent, that means if you are a party to the conversation and you consent to recording it you have done so legally.~
